ImgMCP (“ImgMCP”, “we”, “us”, or “our”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy. We have created this Privacy Policy to inform you of our policies and practices regarding the collection, use, and disclosure of your personal data when you use our technical services that facilitate access to AI-powered multimedia models, "ImgMCP," and the choices you have associated with that data.
This Privacy Policy applies to all personal data collected through any written, electronic, or oral communications, as you:
- Access our website (www.imgmcp.com) and all corresponding webpages and websites that link to this Privacy Policy (the “Site”);
- Utilise our technical services, which provide access to third-party AI-powered multimedia models, including via browser or API (the “Service”).
Before using our Site and Service, please carefully read our Terms of Service and this Privacy Policy. By using this Site or Service, you consent to the collection, use, and disclosure of your personal data in accordance with this Privacy Policy and our Terms of Service. If you do not agree with any part of this Privacy Policy or our Terms of Service, you should not use or access our Site or Service.
We may also provide additional "just-in-time" disclosures or further information about the data collection, use, and sharing practices of specific parts of our Service. Such notices may supplement or clarify our privacy practices or may provide you with additional choices about how we process your personal data.

If your Inputs contain personal data, this will be processed by us to facilitate the provision of the Service, which includes transmitting your Inputs to the third-party AI Models you choose to use through our Service.
- Correspondence: If you contact us (e.g., for customer support), we will collect records and copies of your correspondence, including email addresses.
- Survey Responses: Your responses to surveys that we might ask you to complete for research and service improvement purposes.
- Search Queries: Your search queries on the Site.
b. Personal Data Collected Automatically:
As you navigate through and interact with our Site or Service, we may use automatic data collection technologies to collect certain information about your device, browsing actions, and patterns, including:
- Usage Details: Details of your visits to our Site and use of our Service, including traffic data, location data (general, not precise), logs, features used, and other communication data.

- Output Data: Our Service facilitates the generation of AI-powered multimedia content, such as images, videos, or other media formats (“Outputs”), based on your Inputs processed by third-party AI Models. These Outputs are made available to you through our Service.
Important Note on Inputs and Outputs:
Your Inputs are sent via our Service to third-party AI models to generate Outputs. ImgMCP does not develop or operate these AI Models itself. We do not control, and are not responsible for, how third-party AI model vendors handle your Inputs or Outputs, including for their model training. We encourage you to review the privacy policies of any third-party AI model vendors whose models may be used as part of our Service. We will provide information on which third-party models are used where feasible.
Data Deletion of Inputs and Outputs: We are committed to minimizing data retention within ImgMCP's systems. User-uploaded Inputs and the AI-generated multimedia Outputs are stored temporarily by ImgMCP to provide the Service (e.g., to allow you to access them and view your history through our platform). This data will be automatically deleted from our active systems after 90 days. We do not retain this data within ImgMCP's systems for any other purpose beyond this period, except as may be required for troubleshooting our Service, security, or legal obligations, in which case it will be for the shortest necessary period. This policy does not govern the retention or deletion practices of the third-party AI Model vendors, which are subject to their own policies.
Cookies and Other Tracking Technologies
We may use cookies, embedded scripts, and other similar tracking technologies (“Tracking Technologies”) to collect additional personal data automatically as you interact with the Site and to personalize your experience.
- Cookies: Cookies are small web files that a site or its provider transfers to your device’s hard drive through your web browser. We use first-party and third-party cookies for purposes such as making our Site function properly, improving our Site and Services, making login easier, recognizing you when you return, tracking interaction, and enhancing your experience.

- Communication: To contact you regarding your account, service updates, administrative messages, and to respond to your inquiries and support requests.
- Improvement and Personalization: To understand how our Service is used (e.g., feature popularity, API usage patterns), to improve and develop new features for our platform, and to personalize your experience with the ImgMCP Service itself. We do not use your specific Inputs or Outputs to train any AI models developed by ImgMCP.
- Marketing: To send you marketing and promotional communications about our products and services, where you have consented or where otherwise permitted by law. You can opt-out of these communications at any time.
- Security and Fraud Prevention: To maintain the security of our Site and Service, combat spam, malware, malicious activities, or security risks, and to prevent fraud.
- Legal and Regulatory Compliance: To comply with applicable laws, regulations, court orders, or other legal processes.
- Enforcement: To enforce our Terms of Service and other policies.
- Aggregated and De-identified Information: We may process personal data in an aggregated or de-identified form (so that it can no longer be associated with you) for research, analytics, and to improve our Service platform and offerings. For example, we may analyze general user behavior and usage data related to our platform. We will not attempt to re-identify de-identified data, except for debugging purposes where necessary and with appropriate safeguards. As stated above, your specific Inputs and Outputs are subject to our data deletion policy for ImgMCP's systems and the policies of the respective third-party AI Model vendors.
3. How We Share and Disclose Your Personal Data
We do not sell your personal data. We may share or disclose your personal data in the following circumstances:
- Service Providers: We engage third-party companies and individuals to facilitate our Service (“Service Providers”). These include:
- Third-Party AI Model Vendors: To process your Inputs and generate Outputs, your Inputs will be shared by our Service with our third-party AI model providers that you select or that are configured for the Service you use. Their use of your data is governed by their respective privacy policies and terms. ImgMCP acts as a conduit for this data.
- Payment Processors: To process your payments securely.
- Cloud Hosting Providers: To host our Site, Service, and associated data.
- Analytics Providers: To help us understand the usage of our Service platform.
These Service Providers have access to your personal data only to perform these tasks on our behalf (or, in the case of AI Model Vendors, to provide the core AI processing you request through our Service) and are, where applicable as our direct processors, obligated by contract not to disclose or use it for any other purpose not aligned with their service to us or to you via our Service. For AI Model Vendors, their own privacy policies will detail their use of data.
- Corporate Transactions: If the legal entity operating ImgMCP is involved in a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of its assets, your personal data may be among the assets transferred. We will notify you via email and/or a prominent notice on our Site of any change in ownership or uses of your personal data, as well as any choices you may have regarding your personal data.
- Legal Requirements: We may disclose your personal data if required to do so by law or in the good faith belief that such action is necessary to:

Please note that we may be required (by law or otherwise) to keep certain information and not delete it, or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements. Our policy on deleting Inputs and Outputs from ImgMCP systems is detailed in Section 1.
- Marketing Communications Opt-Out: You can opt-out of receiving promotional emails from us by following the "unsubscribe" link provided in those emails or by contacting us. Please note that you may still receive transactional or administrative messages related to your account and our Service even if you opt-out of marketing communications.
- Tracking Technologies and Advertising: You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly. 5. Data Security
We have implemented appropriate technical and organizational measures designed to secure your personal data from accidental loss and from unauthorized access, use, alteration, and disclosure. All personal data you provide to us is stored on secure servers. Any payment transactions will be encrypted using SSL technology or similar.

We encourage you to review the privacy policies of any third-party services, especially the AI Model vendors you utilize through our Service, before providing any personal data to them or using their services.
7. Personal Data Retention
We will retain your personal data within ImgMCP's systems only for as long as is necessary for the purposes set out in this Privacy Policy, including for the purposes of satisfying any legal, accounting, or reporting requirements.
- Account Information: We retain your account information for as long as your account is active and for a reasonable period thereafter in case you decide to re-activate the Service, or as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
- Inputs and Outputs: As stated in Section 1, user Inputs and generated multimedia Outputs are retained by ImgMCP for 90 days to provide the Service (e.g., access to history through our platform) and then are automatically deleted from our active systems. This does not govern the retention practices of third-party AI Model vendors.
- Other Data: Other personal data will be retained for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.
When personal data is no longer required by ImgMCP for the stated purposes, we will securely destroy, delete, or anonymize it in accordance with applicable laws and our internal policies.
8. Children's Privacy
Our Site and Service are not intended for individuals under the age of 13. We do not knowingly collect personal data from children under 13. If you are under 13, do not use or provide any information on this Site or through any of its features, register on the Site, make any purchases through the Site, use any of the interactive features of this Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal data from a child under 13 without verification of parental consent, we will delete that information. For users between 13 and 18 (or the age of majority in their jurisdiction), they may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by our Terms of Service and this Privacy Policy.
9. Data Transfers
Your information, including personal data, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction.
If you are located in the United Kingdom (UK) or European Economic Area (EEA), your personal data may be transferred outside the UK/EEA, for example, to our Service Providers (including third-party AI model vendors or cloud hosting providers) located in other countries, such as the United States. When you use our Service to send Inputs to third-party AI Model vendors, your data is necessarily transferred to the location of those vendors or their processing facilities.
When we transfer your personal data out of the UK/EEA to our direct processors, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
- We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the UK government (adequacy regulations).
- Where we use certain service providers, we may use specific contracts approved by the UK Information Commissioner's Office which give personal data the same protection it has in the UK (e.g., Standard Contractual Clauses adapted for UK international transfers).
- For transfers to third-party AI Model vendors that you choose to use via our Service, the data protection measures will be those described in their respective privacy policies and terms, and the legal basis for such transfers from your perspective will often be the necessity of the transfer for the performance of the service you are requesting from them through ImgMCP.

10. Governing Law
This Privacy Policy and any disputes arising out of or related to it shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law principles.

We process your personal data for the purposes outlined in this Privacy Policy, primarily:
- To provide the Services to you and fulfill our contractual obligations as set forth in our Terms of Service. This includes creating your account, facilitating the transmission of your Inputs to third-party AI Models, delivering Outputs to you, and processing transactions.
- For our legitimate business interests, which include operating, maintaining, and improving our Site and Service; developing new features; understanding how our Service is used; ensuring the security of our platform; preventing fraud; communicating with you about your account or service updates; and for marketing and promotional efforts in compliance with applicable law and your expressed preferences.
- To comply with applicable legal and regulatory obligations, and legal processes.
- With your consent, for specific purposes that we may communicate to you. Where we rely on your consent, you will have the right to withdraw it at any time.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated "Last Updated" date at the top. Your continued use of our Service after such changes have been posted will constitute your acceptance of the revised Privacy Policy. We encourage you to review this Privacy Policy periodically for any changes. We will not provide separate notifications of such updates.
